Agreement

These terms govern use of the Beacons environmental and acoustic monitoring platform (the “Service”), operated by Beaconsio LLC. By accessing or using the Service you agree to these terms.

The Service is used both by organizations, whose accounts are issued and administered by an organization administrator, and by individuals who sign up directly. In these terms, “you” means the person or entity accessing the Service. Where you access the Service through an account issued by an organization, these terms apply to you individually and that organization’s arrangement with us governs that organization’s use. Where a separate written agreement exists between Beaconsio LLC and your organization, that agreement controls if it conflicts with these terms.

You must be at least 18 years old to create an account.

The service

Beacons provides live sound-level and environmental monitoring, schedule-aware compliance analysis, alerting, and report generation, using monitoring devices deployed for you or your organization together with a web dashboard. Access to the dashboard requires an account — issued by us, created by your organization’s administrator, or created by you through self-service signup.

Some features are available only under a paid or organization plan. We may change which features are included in any plan, and we may modify, suspend, or discontinue free-tier access at any time.

Accounts and acceptable use

You are responsible for your credentials and for activity under your account. You agree not to misuse the Service — including attempting to access another organization’s data, probing or disrupting the platform, reverse engineering the platform or Beacons hardware, or using the Service in violation of law.

Your data

Monitoring data collected during your monitoring sessions belongs to you, or to your organization where the session is conducted under an organization account. You grant us the rights needed to host, process, analyze, and display that data in order to provide the Service, including generating compliance reports and summaries, verifying device calibration and measurement integrity, performing quality assurance, and conducting after-the-fact audits of measurement data.

We may also use measurement data in aggregated and de-identified form that does not identify you, your organization, your venue, or any event, for the purposes of developing, testing, validating, and improving our products, models, methodologies, and the Service. We will not attempt to re-identify individuals from de-identified data, and we will not publish or publicly disclose measurement data attributable to you or your organization without prior written consent.

Monitoring data and compliance disclaimers

Measurement quality depends on device placement, calibration, and site conditions. Compliance indications and reports produced by the Service are informational tools: they do not constitute legal advice, and final determinations of regulatory compliance rest with the applicable authorities. Portions of reports and summaries are generated with AI and should be reviewed before being relied upon. Free-tier and unsupervised deployments in particular have not been validated for any regulatory or contractual compliance purpose, and readings from them should not be relied upon as evidence of compliance.

Availability

The Service is provided “as is” and “as available”. We work to keep monitoring resilient — including buffering of measurement data on the device through connectivity loss — but we do not warrant that the Service will be uninterrupted or error-free. Monitoring devices resolve sound-pressure levels and related acoustic metrics, and classify the sound environment into categories on the device; they do not record or retain audio. Intellectual property

The Beacons platform, software, branding, and Beacons hardware designs are proprietary to Beaconsio LLC and its licensors. No rights are granted except as needed to use the Service.

Limitation of liability

To the maximum extent permitted by law, Beaconsio LLC is not liable for indirect, incidental, special, or consequential damages, or for fines, penalties, or losses arising from reliance on monitoring data or reports. Our total aggregate liability for any claim arising out of or relating to these terms or the Service is limited to the greater of one hundred dollars ($100) or the amounts paid for the Service in the twelve months preceding the claim.

Nothing in these terms limits liability that cannot be limited under applicable law.

Termination

We may suspend or terminate access for breach of these terms. You may stop using the Service and close your account at any time, and your organization may end its use of the Service at any time. Data retention and deletion following termination are described in our Privacy Policy or in your organization’s agreement.

Governing law and venue

These terms are governed by the laws of the State of Oregon, without regard to its conflict of law rules. You and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Multnomah County, Oregon, for any dispute arising out of or relating to these terms or the Service, and waive any objection to that venue. Either party may seek injunctive or other equitable relief from any court of competent jurisdiction to protect its intellectual property or confidential information.

Assignment

You may not assign or transfer these terms, or any rights or obligations under them, without our prior written consent, and any attempted assignment without that consent is void.

We may assign or transfer these terms, in whole or in part, together with the accounts, data-handling commitments, and other rights and obligations under them, to an affiliate or to a successor in connection with a merger, reorganization, change of control, incorporation of a successor entity, or sale of all or substantially all of the assets to which the Service relates. We will note any such assignment on this page with an updated date, and the successor will be bound by these terms as they then stand.

These terms bind and benefit the parties and their permitted successors and assigns.
